摘要：El objetivo de este trabajo es analizar, a través de la regulación existente en Estados Unidos y en la Unión Europea, cuál es la situación real sobre la posibilidad de acceso de las entidades bancarias a clientes potenciales de otros países a través de la vía Internet. La metodología utilizada es de carácter descriptivo obteniendo como principal conclusión que la deseabilidad por parte de las entidades bancarias de captar clientes en otros países distintos del de origen, debido a la, en principio, facilidad de acceso a los mismos mediante Internet, exige a las entidades bancarias conocer la regulación existente en dichos países y, en la mayoría de los casos, esta regulación sobre banca transterritorial es confusa. Esto supone para la banca un incremento importante de su riesgo legal y reputacional, y para el potencial cliente: desconfianza e inseguridad a trabajar con bancos por Internet de otros países.
其他摘要：The aim of this work is to analize through the existent regulation in the United States an the European Union which is the real situation about the possibility of access of the banking entities to potential customers of other countries through the Internet. The methodology used has a descriptive measure and its main conclusion is that the desire of banking entities of winning over customers in different countries from that of the origin, due to the easiness of access they find through the Internet, demands to the banking entities to know the existent regulation in these countries. In most of the cases this regulation about transterritoriality is unclear. This fact involves for banking an important increase of its legal and considered risk, and for the potential customer: distrust and uncertainty of working with banks of other countries through the Internet.
