摘要:Early every morning 2,000 men andwomen, many of whom haverecently immigrated to Canada,deliver the Toronto Star to tens ofthousands of homes in metropolitanToronto as their primary source ofincome. Five days a week, about6,000 couriers, a significant majorityof whom are women, drive acrossrural and suburban Canadadelivering the mail. In Torontoevery day, hundreds of women,many who are women of colour andnew to Canada, travel to work inprivate homes to provide personalcare for disabled, ill, and elderlypeople. Across Canada professionaleditors, most of whom are women,work in their home compilingindexes, making tables, and plyingthe skills of their trade for a varietyof clients. In recent years each ofthese groups of workers has tried touse the law to obtain collectivebargaining rights and they havefaced an up-hill battle. In each casethe workers' status as self-employedwas a contentious legal issue. Manyof these workers, although not all,are also denied basic forms of labourprotection such as the minimumwage, occupational health andsafety laws, and employmentinsurance because of their self-employed status. Moreover, some ofthem may be classified as self-employed for some purposes, suchas taxation, at the same time as theyare classified as employees forothers, such as collectivebargaining.2
